US voters are heading to the polls for midterm elections that could determine the future of cryptocurrency regulation and congressional oversight. Crypto industry groups have invested roughly $176 million across more than 100 races this election cycle, primarily through the Fairshake political network financed by Coinbase, Ripple, and Andreessen Horowitz. The stakes involve control of Congress, where Republicans currently hold majorities in both the House (219 seats) and Senate (53 seats), while prediction markets favor a Democratic shift.

A change in congressional leadership would significantly impact the stalled CLARITY Act, a market structure bill that failed to advance in the Senate on September 15 after a 49–50 procedural vote. If Democrats gain control, they may increase scrutiny of Trump-linked crypto businesses and influence regulatory confirmations. Key races include Ohio, where industry groups reportedly spent over $50 million against Democrat Sherrod Brown, and Nebraska, where Fairshake contributed nearly $11 million to support Republican Senator Pete Ricketts. In Texas, the Winklevoss-backed Digital Freedom Fund is backing Republican Ken Paxton.

Despite the uncertainty surrounding the CLARITY Act, the industry has already secured the GENIUS Act, which established a federal stablecoin framework upon becoming law in July 2025. Analysts note that Bitcoin’s historical performance following past midterms offers limited guidance for current market movements, citing institutional flows and macroeconomic factors as more immediate drivers.
